If an employer does not pay gratuity or the final settlement looks wrong, start by checking the numbers calmly. Compare your joining date, last working date, basic salary, unpaid leave, unused annual leave, notice period, and any deductions. Do not rely only on a verbal promise. Keep written records and compare the employer’s calculation with your own estimate. If the difference is meaningful, check official UAE labour channels or speak to a qualified professional.
Example calculation
If your employer calculated gratuity from AED 4,000 basic salary but your contract says AED 6,000, that difference can materially change the final number.
Common estimate rules
- Less than 1 year of service: commonly estimated as no gratuity.
- 1 to 5 years: commonly 21 days of basic salary per completed year.
- More than 5 years: commonly 21 days per year for the first 5 years, then 30 days per extra year.
- Total gratuity is generally capped and special cases may change the result.
